Viet Cal Volunteer/Participant Agreement and Waiver and Release of Liability
PLEASE READ CAREFULLY! THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS!
Viet Cal is a volunteer nonprofit corporation created in part to teach, and to organize and coordinate volunteers to travel to Vietnam, among other places, to provide healthcare, including without limitation, to perform orthopedic surgeries.
I desire to participate in a Viet Cal event and/or I desire to volunteer to work with Viet Cal to help aid person(s). I understand and acknowledge that I will be providing my services solely as a volunteer, and that I will not be compensated in any manner for such services. I furthermore hereby freely, voluntarily, and without duress, agree as follows:
ASSUMPTION OF RISK: I understand that some activities that I may do (the “Volunteer Activities”), including, but not limited to, participating in Viet Cal event(s)/trainings, traveling to and living in other countries, volunteering, providing healthcare, performing surgeries, etc., may entail activities hazardous to me and/or may involve certain risks, including serious injury or death. Despite such risks, I still choose to participate in the Volunteer Activities. I hereby expressly and specifically assume the risk of injury or harm in the Volunteer Activities, including any injury or harm in travel to and from the sites of these activities, and release Viet Cal, it's officers and board of directors, any agent, person, volunteer, agent or entity associated with Viet Cal, and my fellow volunteers (collectively, the “Released Parties”) from all liability for injury , illness, death or property damage.
RELEASE & WAIVER: I HEREBY RELEASE AND FOREVER DISCHARGE AND HOLD HARMLESS THE RELEASED PARTIES AND THEIR SUCCESSORS AND ASSIGNS FROM EITHER IN LAW OR IN EQUITY, THAT ARISE OR MAY HEREAFTER ARISE FROM MY VOLUNTEER ACTIVITIES, INCLUDING WITHOUT LIMITATION EVENT(S) PARTICIPATION, TRAVEL, PROVIDING HEALTHCARE, WHETHER CAUSED BY THE NEGLIGENCE OF ANY RELEASED PARTY OR OTHERWISE.
MEDICAL TREATMENT: I hereby release and forever discharge the Released Parties from any claim whatsoever that arises or may hereafter arise on account of any first aid, medical treatment or services rendered to me in connection with my Volunteer Activities.
NO INSURANCE COVERAGE OR BENEFITS: I understand that neither Viet Cal nor any other Released Party assumes any obligation to provide me with financial or other assistance, including, but not limited to, medical, heath, vehicle, or disability insurance in the event of my injury or illness. I understand that Viet Cal has no insurance policy that covers me in any way, and that I am expected and encouraged to make sure that I have my own medical, heath, vehicle insurance coverage. I understand and agree that my own vehicle insurance policy will cover any loss concerning myself and/or my vehicle. I understand that Viet Cal does not have a medical malpractice insurance policy and that I a solely responsible for my own medical malpractice insurance policy to cover any loss concerning myself.
BROAD RELEASE: I expressly agree that this release is intended to be as broad and as inclusive as permitted by the laws of the State of California, and that this document shall be governed by and interpreted in accordance with the laws of California. I agree that in the event that any clause or provision of this release shall be held to be invalid by any court of competent jurisdiction the invalidity of such clause of provision shall not otherwise affect the remaining provisions of this release, which shall continue to be enforceable. If any legal proceeding or other legal action relating to this release is brought or otherwise initiated, the venue therefore will be in California, which is deemed to be a convenient forum.
